Name Bangla https://en.namebangla.com/ is committed to protecting the intellectual property rights of others and expects its users to do the same. While Name Bangla operates under the laws of the People’s Republic of Bangladesh, we are dedicated to upholding intellectual property rights globally and have adopted procedures consistent with the Digital Millennium Copyright Act (“DMCA”) of the United States and other applicable international copyright laws to address claims of copyright infringement.
This policy outlines the process for copyright holders to request the removal of allegedly infringing content from our Site and for users to respond to such requests.
1. Reporting Copyright Infringement (DMCA Takedown Notice)
If you are a copyright owner or an agent thereof and believe that any content on the Name Bangla Site infringes upon your copyrights, you may submit a written notification (“Takedown Notice”) to our Designated Copyright Agent pursuant to the DMCA.
To be effective, your Takedown Notice must be a written communication that includes substantially the following:
- Identification of the Copyrighted Work:

- A clear and concise identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works. This should include titles, authors, URLs if published online, registration numbers (if applicable), or other sufficient identifying information.
- Identification of the Allegedly Infringing Material:

- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Name Bangla to locate the material. Providing URLs to the exact location of the allegedly infringing material on https://en.namebangla.com/](https://www.google.com/search?q=https://en.namebangla.com/%24) is highly recommended. Screenshots are also helpful but not a substitute for URLs.
- Contact Information of the Complaining Party:

- Information reasonably sufficient to permit Name Bangla to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- Statement of Good Faith Belief:

- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Statement of Accuracy and Authority:

- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. This means you must be the copyright owner or have explicit permission from the copyright owner to act on their behalf.
- Physical or Electronic Signature:

- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. An electronic signature can be achieved by typing your full legal name.
Please send your Takedown Notice to our Designated Copyright Agent at the address provided in Section 5 of this policy.
Upon receipt of a valid Takedown Notice, Name Bangla will promptly investigate the claim. If we determine, in our sole discretion, that the material is indeed infringing, we will take appropriate action, which may include removing or disabling access to the infringing material. We will also notify the user who posted the allegedly infringing content about the removal and provide them with information on how to file a counter-notification.
Please be aware that filing a false or misleading DMCA notice may result in liability for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA.
2. Counter-Notification (Responding to a Takedown)
If you are a user of Name Bangla and believe that material you posted on the Site was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled, you have the right to submit a counter-notification (“Counter-Notice”) to our Designated Copyright Agent.
To be effective, your Counter-Notice must be a written communication that includes substantially the following:
- Identification of Removed Material:

- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. Providing the URL(s) of the removed content is crucial.
- Statement of Good Faith Belief:

- A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- User’s Contact Information:

- The subscriber’s name, address, and telephone number.
- Consent to Jurisdiction and Acceptance of Process:

- A statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which Name Bangla may be found, and that the subscriber will accept service of process from the person who provided the original Takedown Notice or an agent of such person.
- Physical or Electronic Signature:

- A physical or electronic signature of the subscriber.
Please send your Counter-Notice to our Designated Copyright Agent at the address provided in Section 5 of this policy.
Upon receipt of a valid Counter-Notice, Name Bangla will send a copy of the Counter-Notice to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced or access to it restored in 10 to 14 business days or more after receipt of the Counter-Notice, at Name Bangla’s sole discretion.
Please be aware that filing a false or misleading counter-notification may result in liability for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA.
3. Repeat Infringer Policy
Name Bangla respects the intellectual property rights of others and is committed to complying with applicable copyright laws. In accordance with the DMCA and other applicable law, Name Bangla has adopted a policy of terminating, in appropriate circumstances and at Name Bangla’s sole discretion, users who are deemed to be repeat infringers of copyrighted material.
A user may be identified as a repeat infringer if they have been subject to multiple DMCA Takedown Notices that have not been successfully challenged by a counter-notification, or if they have otherwise demonstrated a pattern of infringing intellectual property rights. Name Bangla reserves the right to terminate accounts, restrict access to content, or take other appropriate action against users who repeatedly infringe copyright or other intellectual property rights.
4. Modification of Content and Account Termination
Name Bangla reserves the right, in its sole discretion, to remove, edit, or disable access to any content on the Site, including user-generated content, at any time and for any reason, with or without notice. This includes material that we believe may be infringing, illegal, offensive, or otherwise in violation of our Terms and Conditions.
Furthermore, Name Bangla reserves the right to terminate any user account at any time, for any reason, including but not limited to, violations of these Terms and Conditions, copyright infringement, or any other activity that we deem detrimental to our Site or its users.

7. Governing Law
This DMCA Policy and all matters relating to it shall be governed by and construed in accordance with the internal laws of the People’s Republic of Bangladesh, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, this policy shall be instituted exclusively in the courts of Dhaka, Bangladesh.
